1. Who we are and what we do
KasiGo SA ("KasiGo", "we", "us") operates an online marketplace that connects customers with independent restaurants and independent delivery drivers in South Africa. KasiGo is not a restaurant and does not prepare, own or sell the food listed on the platform. We do not employ drivers; drivers use the platform to accept delivery work on their own account.
Where a restaurant delivers its own order, the contract for the food is between you and that restaurant. Where a KasiGo driver is assigned, KasiGo arranges the transport of the order between the restaurant and you.
2. Accounts and eligibility
- You must be at least 18 years old, or use the platform under the supervision of a parent or guardian who accepts these terms.
- You must give accurate, current and complete information and keep your password secure. You are responsible for activity carried out under your account.
- One account belongs to one person or one registered business. Do not share, sell, rent or transfer an account, or create duplicate accounts.
- Restaurants must hold the business registration, trading licences and food-safety certificates their municipality requires. Drivers must hold a valid licence, a roadworthy vehicle and the insurance that vehicle needs.
- We may suspend or close an account that is used unlawfully, fraudulently, or in breach of our Acceptable Use Policy.
3. Orders, prices and availability
- Restaurants set their own menu prices. Prices, availability and preparation times shown on KasiGo are set by the restaurant and may change without notice.
- An order is only confirmed once a restaurant accepts it. If a restaurant declines or cannot fulfil an order, the order is cancelled and you are not charged, or any amount already paid is refunded in full.
- The delivery fee shown before you pay is calculated from the delivery distance, and a minimum fee applies to short trips. The fee shown at checkout is the fee you pay.
- Order minimums, if any, are set by the restaurant and are shown before you pay.
- You must give a correct delivery address and contact number. If a driver cannot reach you or find the address, the restaurant and driver are not liable for a spoiled or lost order.
- Alcohol and age-restricted items may only be delivered to, and handed over to, a person of legal drinking age.
4. Payments
- We accept card and instant bank payments through our licensed payment provider, Paystack. Card details are handled by Paystack and are not stored on KasiGo servers.
- Cash on delivery and pay-with-restaurant options are not supported on KasiGo; every order is paid through the app before it is prepared.
- Payment is taken when the order is confirmed. Amounts are shown in South African Rand (ZAR) and include VAT where the seller is a VAT vendor.
- Promotions, referral rewards and credits have their own rules and expiry dates. Rewards are platform credit, not cash, and cannot be exchanged for money or transferred.
- If a payment fails after your order was accepted, we will contact you. Repeated failed payments on accepted orders may lead to account review.
5. Cancellations, refunds and disputes
You may cancel free of charge while the order is still being accepted by the restaurant. Once a restaurant confirms and begins preparing, cancellation may not be possible and the full amount may be retained. Delivery collection ("Collect") orders follow the same rule.
If an order is wrong, incomplete, spoiled or not delivered, report it in the app or to support@kasigo.app within 24 hours with your order number and photos where relevant. We investigate with the restaurant and driver, and where your claim is upheld you may receive a full or partial refund, platform credit, or a replacement order. Refunds are returned to the original payment method and may take 5-10 business days to appear, depending on your bank.
Claiming a refund for an order you knowingly received, or repeatedly making unsupported claims, is treated as fraud and may lead to account closure and reporting to our payment provider.
6. Restaurants, drivers and earnings
- KasiGo charges a platform commission on each completed order. The rate applied to your restaurant is shown in your partner dashboard before you accept an order.
- Restaurant payouts are calculated after commission. Delivery fees belong to the driver assigned to the trip.
- Payouts and driver withdrawals follow the schedule, minimum balance and verification rules published in the partner portals; a bank account in the account holder's own name is required before funds are released.
- Restaurant and driver earnings are never reduced by a customer discount funded by KasiGo.
- You must keep tax records for your own earnings. KasiGo does not file tax returns on your behalf.
- Do not move customers off-platform to avoid fees. Orders arranged through KasiGo remain subject to these terms.
7. Your content, reviews and conduct
Reviews, photos and messages you post stay yours, but you give KasiGo permission to display and moderate them on the platform. Reviews must be honest and based on a real order. We may remove content that is abusive, false, defamatory, discriminatory or unlawful.
Order chat exists to complete the delivery. It must not be used for harassment, spam, or to arrange payment or contact outside KasiGo.
8. Service availability, fees and changes
We aim to keep the platform running, but we do not guarantee uninterrupted access. Delivery areas, fees, commission rates and partner terms may change; where a change affects a partner materially we will publish it in the partner portal before it applies. Continued use after a change means you accept it.
9. Liability
KasiGo takes reasonable care in operating the platform. We are not liable for indirect losses such as lost profits, and our total liability for any claim is limited to the amount you paid for the order concerned, unless South African law provides otherwise. Nothing in these terms excludes liability for fraud, wilful misconduct, death or personal injury caused by our negligence, or any right you cannot lawfully give up under the Consumer Protection Act 68 of 2008.
Restaurants remain responsible for the food they prepare and serve. Drivers remain responsible for their conduct and compliance with road traffic law while delivering.
10. Personal information
We process personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy, which also explains what we share with restaurants, drivers and our payment provider and how to exercise your rights.
11. General
- These terms, together with our Privacy Policy, Acceptable Use Policy, Shipping & Delivery and Refunds & Returns policies, are the whole agreement between us about the platform.
- If part of these terms is found unenforceable, the rest still applies.
- If we do not enforce a clause once, that does not mean we give it up.
- These terms are governed by South African law, and the parties agree to the jurisdiction of the South African courts.
